This notice explains how Omega Care collects, uses and protects personal information through this website. Please read it carefully so you know why and how we use the information we hold about you.

We are Omega Care Group Limited, a company registered in England and Wales with company number 09596061, whose registered office is at 40-42 Kemble Street, Prescot, Liverpool, L34 5SQ. Omega Care is a trading name of Omega Care Group Limited. In this notice we refer to ourselves as "we", "us" or "our".

We are the data controller for the personal information described here. You can contact us in any of the following ways:

We take the privacy and the security of the personal information we hold about you seriously. We may give you other privacy notices from time to time, including when we collect information from you directly. This notice is intended to supplement those and does not replace them.

2. Key terms

Data controller

Under UK data protection law, this is the organisation responsible for deciding how personal information is collected, stored and used.

Data processor

An organisation appointed by a controller to carry out certain tasks with personal information, on the controller's written instructions. Website hosting and email marketing platforms are common examples.

Personal information

Any information from which a living individual can be identified. We use this phrase throughout instead of "personal data". It does not apply to information that has been anonymised.

Special category information

Particularly sensitive information that attracts extra protection in law. It includes information about health, racial or ethnic origin, political opinions, religious or similar beliefs, trade union membership, sex life and sexual orientation, together with genetic and biometric information.

3. The information we collect

The categories of personal information we collect and hold through this website are set out below. What we hold about you will differ from person to person, depending on who you are and your relationship with us.

• Contact informationYour email address, telephone or mobile number, postal address, and your preferred way of being contacted.
• Enquiry informationThe reason for your enquiry and anything you choose to tell us in a message, a form or a conversation with us.
• Education and career informationWhere you register an interest in working with us as a student or a candidate, your course or degree subject, your year of study or graduation, whether your course includes a placement, and any other detail you give us about your background.
• Marketing and communications informationYour preferences about receiving information from us, and any consent you have given or withdrawn.
• Website, device and technical informationInformation about how you use this site, including your IP address, browser type and version, operating system, time zone and location settings, and other information we receive about your device.

4. Special category information

We do not ask for special category information through this website, and we do not ask about criminal convictions or offences here. Please do not include information of that kind in a website form or an unsolicited email.

If you send it to us anyway, or if you go on to apply for a role and we need it as part of safer recruitment, we will only use it where the law allows. That will usually be with your explicit consent, where it is necessary in connection with legal claims, where it is necessary for employment or safeguarding purposes, or where you have deliberately made the information public. In that case we will give you a separate notice explaining what we are doing.

5. How and why we use your information

We can only use your personal information where the law gives us a reason to. In most cases we rely on one of the following:

• ContractUsing your information is necessary to perform a contract we have with you, or to take steps at your request before entering into one.
• Legitimate interestsUsing your information is necessary for our interests or those of a third party, provided your rights, freedoms and interests do not override them. Where we rely on this, we tell you what the interest is.
• Legal obligationWe have to use your information to comply with a legal duty.
• ConsentYou have given us your consent to use your information for a specific purpose.

The purposes we use your information for, and the legal reason for each, are set out below. For some purposes more than one reason may apply, because the position can differ from case to case. If you want confirmation of the reason we are relying on in your case, please contact us.

• Answering your enquiryReplying to you and staying in touch about what you asked us. Contract, and legitimate interests (responding to people who approach us and running our services properly).
• Referrals and placementsResponding to a referral or a placement enquiry from a local authority or another professional. Contract, and legitimate interests (arranging care and support for children and young people).
• RecruitmentAttracting, contacting and assessing people interested in working with us, including students who register an interest, and holding their details so we can tell them about suitable roles, open events and career routes. Legitimate interests (recruiting and retaining the staff our services depend on), and consent where you have opted in to hear from us.
• Managing our agreement with youCarrying out any agreement we have with you and telling you about changes to it. Contract, and legal obligation.
• Meeting our legal dutiesComplying with our regulatory, safeguarding, audit and accounting obligations. Legal obligation.
• Improving what we doDeveloping the services and information we provide. Legitimate interests (improving our services for the people we support and developing our organisation).
• Keeping in touchSending you information about our services, roles and events that may interest you, as described in section 12. Legitimate interests (growing our organisation), and consent.
• Running this websiteKeeping the site working correctly and protecting it against misuse. Legitimate interests (making sure our website is available and secure).
• Website analyticsUnderstanding how visitors use this site so we can improve it. Consent, given through our cookie banner.

If you do not give us the information we ask for, we may not be able to answer your enquiry, consider a referral, or take an application forward. Please keep your details up to date and tell us if anything changes.

Where we rely on your consent, you can withdraw it at any time by contacting us using the details in section 1. We will then stop using your information for that purpose, unless we have another legal reason to continue, in which case we will tell you what it is.

We sometimes anonymise information so that you can no longer be identified from it, and combine it with other people's information to produce statistics. Because you cannot be identified from that combined information, we are free to use it for our own purposes.

If we ever want to use your information for a new purpose that is not compatible with the purposes above, we will contact you first to explain it and to tell you what legal reason allows it.

6. How we collect your information

Most of the information we hold comes directly from you, when you complete a form on this website, email or phone us, write to us, meet us at an event, or otherwise get in touch.

We also receive some information from other sources, including:

• local authorities, placing authorities and other professionals who contact us about a child, young person or family
• publicly available sources such as Companies House and professional networking sites
• referees and background checking services, where you have applied for a role and we have told you we will approach them
• analytics providers, who supply website, device and technical information

We also collect website, device and technical information automatically through cookies and similar technologies. Our Cookie Policy explains this in more detail.

We do not buy personal information from data brokers or list sellers.

7. Who we share your information with

We share personal information only where we need to. The organisations we may share it with are:

• other companies in our group, who may act as joint controllers or as processors on our behalf, for example for IT and HR support
• suppliers who provide services to us, such as IT support and hosting, website and form providers, email and communications platforms, recruitment and HR systems, and professional advisers
• regulators and public bodies, including Ofsted, Care Inspectorate Wales, local authorities, safeguarding partners and HMRC
• our advisers, such as lawyers, accountants, auditors and insurers, and our bankers
• anyone proposing to buy our business or assets, in which case we may disclose personal information to them

Depending on the circumstances, those organisations act either as processors or as controllers in their own right. Where an organisation acts as our processor, we put a contract in place setting out what they may do with the information and how they must protect it.

We may also disclose information where we are required or permitted to by law, including where we have a safeguarding duty to do so.

We do not sell or trade your personal information.

8. Where your information is held

Some of the suppliers we use are based outside the United Kingdom, or store information on servers outside it. In particular, the forms on this site and our website analytics are provided by Google, which processes information in the United States and elsewhere.

Whenever personal information is transferred outside the UK, we make sure a similar level of protection applies, by relying on UK adequacy regulations for the receiving country, or on standard contractual clauses approved for use in the UK together with any additional safeguards that are needed. You can ask us for details of the safeguards in place.

9. How long we keep your information

We keep personal information only for as long as we need it for the purpose we collected it for, including to meet any legal, accounting, regulatory or reporting duty, and to deal with any claim that may arise. As a guide:

• general enquiries made through this website are kept for up to 2 years from your last contact with us
• details submitted when you register an interest in working with us are kept for up to 2 years from your last contact with us, or until you ask us to remove them
• records relating to referrals, placements and the care we provide are kept in line with the statutory retention periods that apply to children's services, which are considerably longer and are set out in the notice covering those services
• accounting records are kept for 6 years

10. How we keep your information secure

We use appropriate technical and organisational measures to protect personal information against loss, misuse, unauthorised access, alteration and disclosure. These include access controls, encryption in transit, limiting access to those who need the information for their role, and staff training. We have procedures for dealing with any suspected breach, and we will tell you and the regulator where we are required to.

11. Your rights

Under UK data protection law you have the following rights in relation to your personal information:

• AccessThe right to obtain a copy of the personal information we hold about you, often called a subject access request, along with certain information about how we use it.
• CorrectionThe right to have inaccurate information corrected and incomplete information completed.
• ErasureThe right, in certain circumstances, to ask us to delete the personal information we hold about you.
• RestrictionThe right, in certain circumstances, to ask us to limit how we use your information.
• PortabilityThe right, in certain circumstances, to ask us to transfer your information to another organisation.
• ObjectionThe right to object to us using your information for direct marketing, and the right to object, on grounds relating to your particular situation, where we rely on legitimate interests. In certain circumstances you can also object to profiling.

Where we rely on consent, you also have the right to withdraw it at any time, as explained in section 5.

To exercise any of these rights, please contact us using the details in section 1. Please note that we may need information from you so that we can verify your identity, that we do not charge a fee unless your request is unfounded or excessive, and that we may refuse to act on a request that is unfounded or excessive. We will normally respond within one month.

12. Marketing

We may send you information about our services, roles and events where you have consented to this, or where we have another legal reason to contact you.

You can change how or whether we contact you at any time. Every marketing email we send contains an unsubscribe link, and you can also contact us using the details in section 1. If you ask us to stop marketing to you, we will still send you communications that are not marketing, such as a reply to an enquiry.

We do not pass your personal information to third parties for their own marketing.

13. Cookies and analytics

This website uses cookies and similar technologies, including Google Analytics, to understand how visitors use the site. Analytics cookies are only set where you have consented through our cookie banner, and you can change your choice at any time. Our Cookie Policy explains which cookies we use and how to manage them.

14. Other websites

This website contains links to other websites, including social media and mapping services. If you follow a link away from this site, the organisation running that website may collect personal information from you. We are not responsible for their privacy practices, so please check their privacy notice to understand how they use your information.

15. Complaints

If you are unhappy with the way we have handled or used your personal information, please contact us first, using the details in section 1, so that we have the chance to discuss it with you and put things right.

You also have the right to complain to the Information Commissioner's Office, the UK supervisory authority for data protection, at ico.org.uk or on 0303 123 1113.
